Buildr AI ("we", "us", "our") is committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform, in compliance with applicable laws including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), the Australian Privacy Act 1988 (Cth), and the Australian Privacy Principles (APPs).
We collect the following categories of personal information:
We use your information to: provide and maintain our services; process transactions and send billing-related communications; respond to your inquiries and provide customer support via AI agents; improve and personalise your experience; send marketing communications (with your consent); comply with legal obligations; and detect and prevent fraud or abuse.
We process your data based on: contractual necessity (to provide our services); legitimate interest (to improve our platform and communicate with you); consent (for marketing and optional features); and legal obligation (tax, accounting, and regulatory requirements).
We do not sell your personal information. We may share data with: payment processors (Stripe, PayPal, Klarna) to process transactions; cloud hosting providers (for data storage and processing); analytics providers (in anonymised/aggregated form); law enforcement when legally required; and business partners only with your explicit consent.
Your data may be transferred to and processed in countries outside your country of residence, including the United States and Australia. We ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) for EU data transfers and compliance with the Australian Privacy Principles for cross-border disclosures.

We implement industry-standard security measures including: AES-256 encryption at rest; TLS 1.3 encryption in transit; regular security audits and penetration testing; access controls and employee training; and incident response procedures.
We retain your personal information for as long as your account is active or as needed to provide our services. Upon account deletion, we will delete or anonymise your data within 30 days, except where retention is required by law.
Our service is not directed to children under 16 (or 13 in the US under COPPA). We do not knowingly collect personal information from children. If we become aware that we have collected data from a child, we will delete it promptly.

By accessing or using Buildr AI ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and Buildr AI Pty Ltd.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Platform. By using the Platform, you represent and warrant that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and promptly update it if it changes. You are liable for all activities that occur under your account.
Buildr AI provides AI-powered tools for creating applications, websites, dashboards, and social media content. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.
You retain ownership of content you create using our Platform. By using the Platform, you grant us a limited, non-exclusive licence to host, display, and process your content solely to provide our services. We retain all rights to our Platform, technology, branding, and AI models.
You agree not to: use the Platform for any unlawful purpose; create content that is harmful, abusive, or infringes on others' rights; attempt to reverse-engineer or interfere with the Platform's functionality; use the Platform to build competing products; or share your account credentials with unauthorised third parties.
Paid plans are billed on a recurring monthly basis. Prices are in USD unless otherwise stated. You authorise us to charge your payment method on file. Failed payments may result in service suspension. All fees are non-refundable except as stated in our Refund Policy.
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
Publishing to third-party app stores (Apple App Store, Google Play) is subject to their respective terms and review processes. Buildr AI does not guarantee approval by any third-party platform. You are responsible for maintaining valid developer accounts with these platforms.
When connecting social media accounts, you authorise Buildr AI to publish content on your behalf. You are solely responsible for all content published through our Platform to your social media accounts. We use OAuth 2.0 for authentication and do not store your social media passwords.
To the maximum extent permitted by law, Buildr AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including Australian Consumer Law.
You agree to indemnify and hold harmless Buildr AI from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. For users in the United States, disputes may be resolved in the courts of the State of Delaware. For users in Australia, nothing in these Terms limits your rights under the Australian Consumer Law.
We encourage resolution through our support channels first. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration, except where prohibited by law. Australian consumers retain the right to bring claims in Australian courts.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance.

Pro and Business plans include a 14-day free trial. You will not be charged during the trial period. Cancel before the trial ends and you will not be billed.
If you are dissatisfied with our service within the first 30 days of your paid subscription, you may request a full refund. Refund requests after 30 days will be considered on a case-by-case basis.
Contact us at billing@buildr-ai.io with your account email and reason for the refund. Refunds are typically processed within 5-10 business days to your original payment method.
For Australian consumers: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a refund or replacement for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
Third-party fees (such as Apple Developer Program or Google Play Developer fees) are not refundable by Buildr AI, as they are paid directly to those third parties.
